These Terms of Service (“Terms”) govern your use of the800.club (the “Site”) and any order you place through it.

The merchant is Jack Vitalie, doing business as The 800 Club (“we,” “us,” or “our”). This is a retail clothing shop. Completing checkout here is a purchase from us — not from the company that built the Site, and not from Squarespace as the seller of the goods.

By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site and do not buy.

1. Who we are

Jack Vitalie d/b/a The 800 Club sells apparel and related merch on this Site.

This is a U.S. shop. Whether we ship outside the United States is not stated yet — see /shipping-policy. Do not assume international checkout works.

The Site runs on Squarespace Commerce. Squarespace hosts the shop and processes checkout. Squarespace is not the merchant of record for the garments. We are.

2. Acceptance

Browsing the Site is acceptance of these Terms for site use.

Completing checkout on this Site is acceptance of these Terms for that order. Your order is binding when checkout completes — that is, when Squarespace accepts the payment for that cart.

If you create a customer account through Squarespace, you are also bound by Squarespace’s own terms for that account.

3. What this shop is

This is a merch shop. We sell printed garments and related items shown on the Site. Many items are print-on-demand (made after you order, not pulled from a warehouse of finished stock).

The Site is not software we license to you, not a hosted app, and not a subscription service. Buying a shirt does not give you a software license.

4. Orders and payment

Prices, sizes, colors, and availability are what the cart shows at checkout. Taxes and shipping charges, if any, are added there.

Payment is taken through Squarespace and its payment partners. We do not receive or store your full card number. Card networks, banks, and Squarespace’s processors have their own terms. Chargebacks and payment disputes follow those networks and Squarespace — contact us at J800club@gmail.com as well so we can look up the order.

We may refuse, cancel, or limit an order if payment fails, if we cannot fulfill it, or if we reasonably believe the order is fraudulent or unlawful. If we cancel after charging you, we will refund the amount we collected for that cancelled order.

You represent that you are authorized to use the payment method you submit.

5. Shipping

Typical production and delivery is 10–21 days from the order. That window is an estimate, not a guaranteed delivery date. Print-on-demand and carriers can run longer.

If that page and these Terms disagree on timing, the shipping policy controls the estimate; these Terms still govern the purchase.

6. Returns and refunds

All sales are final. We do not offer a return window, exchanges, or refunds because you changed your mind, ordered the wrong size, or do not like the print.

That rule matches what we publish on INFO and on /refund-policy. We do not invent a return period here.

If an item arrives damaged or we sent the wrong item, email J800club@gmail.com with your order number and photos. We will look at it. Any remedy we offer in that case is what we agree with you in writing — not a general right to return.

7. Photos, colors, and print-on-demand

Product photos are examples. Colors on a screen are not a lab match to fabric. Print placement, ink, dye, and fabric can vary from the photo and from one run to the next.

We do not promise factory-perfect color, print, or finish. Variation of that kind is not a defect by itself.

Descriptions, size charts, and color names are provided to help you choose. Measure against the size information on the product page. We are not responsible if you pick a size that does not fit you.

8. Kids’ items

We sell some children’s sizes, including Kids’ Shorts. The buyer is the adult. You must be 18 or older to place an order.

If you buy kids’ clothing, you are purchasing as a parent, guardian, or other adult. Do not submit a child’s payment method or create an account in a child’s name.

9. Using the Site

Use the Site lawfully. Do not:

  • interfere with checkout, inventory, or other customers
  • scrape, harvest, or bulk-copy the catalog beyond ordinary browsing
  • probe, overload, or attempt to break the Site or Squarespace
  • use the Site to commit fraud

We may suspend access if we reasonably believe you are doing any of the above.

If Squarespace offers an account, you are responsible for the credentials you set. We do not run a separate login system of our own.

10. Other services

Checkout, hosting, and site software are Squarespace. Instagram and any other links leave this Site. Those companies’ terms and privacy policies apply to what they do. We do not promise their services will always be available or that they will match this catalog at every moment.

If a third-party page and this Site disagree about price, cart, or whether an order went through, the Squarespace checkout record controls.

11. Intellectual property

Artwork, names, logos, photos, and product designs on this Site belong to Jack Vitalie d/b/a The 800 Club, or are used with permission.

Buying a garment lets you wear and keep that physical item. It does not give you the right to copy the designs, reprint them, use our marks, or clone this shop.

Do not use our names, artwork, or photos to sell competing goods or to pass yourself off as The 800 Club.

12. Disclaimer

The Site is provided as is and as available. We do not promise uninterrupted access, error-free pages, or that every product photo will match the item in your hands.

Except for what these Terms and the law actually require, we do not add extra warranties — including any implied promise that goods are merchantable or fit for a particular purpose. Some states do not allow certain disclaimers. Where that is true, those limits apply only as far as the law allows.

We do not guarantee a particular look, athletic performance, or that a garment will last a set number of washes.

13. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential damages — including lost profits, lost data, or substitute-goods costs — arising from the Site or from an order.
  • For any claim about an order, our total liability is the amount you paid us for that order.
  • For any claim about using the Site without an order, our total liability is $50.

This is a clothing shop. These limits are about garments and this website — not a software-license cap, not a professional-services fee cap, and not a cap measured as if you were paying us for an app.

Some states do not allow certain limitations. Where that is true, our liability is limited to the fullest extent the law of Florida allows.

Nothing here limits liability that the law does not let us limit (for example, where a statute says we cannot).

14. Indemnity

You will cover us for claims, damages, and reasonable legal fees that come from: your misuse of the Site, your violation of these Terms, or your infringement of someone else’s rights in connection with your use of the Site.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

Before filing a claim, email J800club@gmail.com and allow 30 days for a good-faith attempt to resolve it.

If that does not resolve it, courts located in Florida have exclusive jurisdiction, except where the law requires otherwise.

16. Changes

We may update these Terms by posting a new version on this page with a new Last updated date. The version in effect when you complete checkout applies to that order. Continued browsing after a posted update is acceptance of the updated Terms for site use.
